TERMS OF SALES

Hereinafter referred to as the “Service Provider” or “MRN”.
ARTICLE 1 – PURPOSE AND SCOPE
1.1 Purpose
These General Terms and Conditions of Sale (hereinafter the “GTCS”) define the rights and obligations of the parties in connection with the sale of hospitality services provided on board the boat “Atlantide 1”, moored in the Port Hercule, Principality of Monaco, during the Formula One Monaco Grand Prix (hereinafter the “Event”).
1.2 Binding effect
The purchase of an access pass (ticket) or the execution of an order form constitutes the Client’s full, unconditional and irrevocable acceptance of these GTCS, which shall prevail over any other document.
1.3 Definitions
• “Client” means any natural or legal person purchasing the services, either directly or through an intermediary.
• “Intermediary” means any entity (agency, works council, third party) acting on behalf of end beneficiaries and guaranteeing their compliance with these GTCS.
ARTICLE 2 – CONTRACT FORMATION AND PAYMENT
2.1 Final nature of the order
The reservation shall be deemed final, binding and enforceable upon receipt by MRN of all or part of the price.
2.2 Payment terms
Unless otherwise agreed in writing, full payment is due at the time of order. Confirmation of the reservation and delivery of tickets (electronic ticket and access wristband) are strictly conditional upon receipt of full payment. In the absence of payment within the prescribed timeframe, MRN reserves the right to cancel the reservation and retain all sums already paid, without prejudice to any other rights.
ARTICLE 3 – TICKETING AND ACCESS CONDITIONS
3.1 Personal and non-transferable tickets
Tickets (electronic ticket and access wristband) are strictly personal, issued in the holder’s name, and non-transferable. Any assignment, resale or exchange is strictly prohibited without MRN’s prior written consent. Any person not appearing on the official Guest List shall be denied access to the boat.
3.2 Ticket delivery
Upon purchase via a payment link or the dedicated website, the Client shall receive an electronic ticket by email, including a personalised QR code. Prior to the Event, the Client shall be informed of the procedures for collecting the access wristband(s) in the Principality of Monaco.
3.3. Access controls
Access to the port and the boat is subject to inspections and controls by the competent Monegasque authorities. Each ticket holder must present a valid official identity document upon request, as well as their electronic ticket and access wristband.
ARTICLE 4 – NO RIGHT OF WITHDRAWAL – CANCELLATION
4.1 No right of withdrawal
In accordance with applicable regulations governing leisure services provided on a specific date, the Client expressly acknowledges that no right of withdrawal applies. Any confirmed order is firm and irrevocable.
4.2. Cancellation by the client
No cancellation, modification or postponement may be requested by the Client for any reason whatsoever.
- No-show
In the event of cancellation or failure by the Client to attend the Event (“No
Show”), one hundred per cent (100%) of the total order amount shall remain definitively due to MRN. - No refund, whether partial or total, shall be granted.
ARTICLE 5 – LIABILITY AND EVENT CONTINGENCIES
5.1 Berth location
For each Grand Prix, MRN shall use its best endeavours to obtain a berth in the “TRACKSIDE” area, at the corner known as “Bureau de Tabac”. The Client expressly acknowledges that this constitutes an obligation of means only. Any refusal, modification or reassignment of the berth by the competent authorities to another TRACKSIDE location shall not give rise to any liability on the part of MRN nor constitute valid grounds for cancellation or refund.
5.2. Force Majeure:
MRN shall not be held liable in the event that the services cannot be performed due to force majeure or events beyond its reasonable control, including, without limitation: accidents, technical failures, terrorist acts, war, strikes, pandemics, adverse weather conditions, sabotage, acts of the Prince, administrative or judicial decisions, refusal of port authorisation, or any other event rendering the boat unavailable or the services impossible to perform.
ARTICLE 6 – ONBOARD RULES AND SAFETY
6.1 Minors
Access is strictly prohibited to minors under the age of twelve (12), unless expressly authorized in writing by MRN’s Management. Any authorized minor remains under the exclusive responsibility of the accompanying adult.
6.2 Conduct and safety
MRN reserves the right to refuse the service of alcoholic beverages and/or to expel any participant whose behaviour is deemed dangerous, inappropriate, disrespectful or who is manifestly intoxicated. Such expulsion shall not give rise to any right to compensation or refund.
ARTICLE 7 – IMAGE RIGHTS AND PERSONAL DATA
Personal data are processed for the purposes of identification, access control, embarkation management, maritime and port security, and the handling of any incidents, on the basis of applicable legal obligations, contractual performance and MRN’s legitimate interest in securing the Event.
Only data strictly necessary for these purposes are collected, including: surname, first name, email address, telephone number, gender, nationality, date of birth and access codes. MRN undertakes not to process sensitive data. Medical information may only be collected at the express request of a passenger and solely for safety purposes.
Data are disclosed exclusively to authorized persons, namely MRN staff, appointed service providers, the Monaco Port Authority, the Automobile Club of Monaco and competent authorities, insurers in the event of a claim, and any authority legally entitled to access such data. Access lists, QR codes and embarkation logs are retained for a period of thirty (30) days following the end of the Event, unless extended due to an incident or dispute.
In case of a dispute or incident, retention continues until the case is closed, after which data are deleted or anonymized.
Ambient images that do not permit identification of individuals may be used, subject to respect for privacy and the right to object.
Each person has the right to access their data, including any video recordings concerning them subject to protection of third parties, as well as the rights of rectification, erasure, restriction, objection and, where permitted by law, portability. These rights may be exercised with MRN by email or postal mail.
MRN guarantees effective exercise of these rights, in accordance with Law No. 1,565 of 3 December 2024, by informing data subjects of all their rights under the applicable legislation on personal data protection.
In the event of a personal data breach likely to result in a risk to individuals, MRN shall notify the APDP as soon as possible and, where feasible, within seventy-two (72) hours, and shall inform the data subjects where a high risk is identified.
Where the breach presents a high risk, data subjects are informed and the protective measures available are specified to them.
The Client undertakes to provide MRN with the guest list and all required information no later than twenty (20) working days prior to the charter, via a secure channel agreed The Client undertakes not to communicate sensitive data and to guarantee the accuracy of the information provided.
Minors aged twelve and over may access the vessel only with MRN’s prior consent and under supervision.
Any processing of their data that is not strictly necessary for access or safety, in particular use of their image for advertising purposes, requires authorization from the legal representative and information drafted in a manner appropriate to the minor’s age.
MRN refuses any grant of rights to its image, notably in connection with television programs (reports, game shows, etc.).
ARTICLE 8 – GOVERNING LAW AND JURISDICTION
8.1. Governing Law
These GTCS are governed exclusively by the laws of the Principality of Monaco.
8.2. Jurisdiction
Any dispute relating to their interpretation, validity or performance shall fall within the exclusive jurisdiction of the courts of the Principality of Monaco, including in summary proceedings, third-party proceedings or in the event of multiple defendants.
LANGUAGE PREVAILING CLAUSE
In the event of any discrepancy, inconsistency or difference in interpretation between the French and English versions of these General Terms and Conditions of Sale, the French version shall prevail and shall be binding in all circumstances.
